What happened: the European Commission classified ChatGPT as a «Very Large Online Search Engine» under the Digital Services Act, alongside Reddit and Roblox — the first time a conversational AI chatbot is regulated as a search engine rather than as a platform, because it «pulls live results from the internet.» With more than 45 million users in the EU, ChatGPT now faces compliance obligations by December 2026: algorithmic transparency, protections for minors and limits on targeted advertising.
Why it matters for agents: a conversational service just stopped being a «product» and became «infrastructure» with platform obligations. The search-engine category was written for deterministic indexes; a generative model that produces its own answers does not fit it, and that definitional tension is where the next rules for any web-enabled agent will be written. Millions of agents already use chatbots as search intermediaries, and under the DSA the layer they rely on is now subject to transparency and risk-evaluation duties: auditing what a model sees and answers moves from good practice to legal obligation, and the design of the agent — what it recommends, to whom, with what transparency — becomes regulatory matter. Europe set the precedent: a conversational AI at scale is governed as infrastructure, not as software.
