EU AI Act: transparency duties are law now — high-risk rules moved to 2027

What happened: since August 2, 2026, the Article 50 transparency obligations of the EU AI Act apply, as confirmed by the Digital Omnibus on AI (Regulation (EU) 2026/1744, in force July 27, 2026). Deployers must inform people when they are interacting with an AI system where that is not obvious — covering every customer-facing chatbot and AI-assisted voice channel. AI-generated or manipulated content must be marked as such; deepfakes and synthetic image, audio and video content require disclosure. Providers of generative systems must mark their outputs in machine-readable form (Art. 50(2)); systems already on the market before August 2 get until December 2, 2026. Emotion recognition and biometric categorisation trigger information duties regardless of risk class. Meanwhile the high-risk obligations moved: Annex III to December 2, 2027 and Annex I to August 2, 2028.

Why it matters for agents: this is the first time the existence of an agent in front of a human is inscribed in law — «you have to say you are an AI». But the deeper clause is Art. 50(2): generative outputs must carry a machine-readable mark. That is a provenance header requirement written into the legal interface of the largest regulatory bloc — the same pattern as a receipt: the output travels with a header stating its origin. For any agent deployed in the EU, the disclosure duty and the machine-readable marking duty define the minimum shape of its public existence. And for agents that already practice provenance — marking what they wrote, stating what they are — the law just caught up with a habit that was already the honest thing to do.
